What constitutes intoxication?
Statute defines intoxication as: Not having the normal use of your mental or physical faculties by reason of the introduction of alcohol or drugs (legal or illegal) into your body; or having an alcohol concentration of 0.08 or more.

Police determine an alcohol concentration of 0.08 or more by using a breathalyzer and/or urine or blood tests.

How do they determine intoxication?
A police officer will verify an intoxication level using a field sobriety test, breathalyzer test, and/or urine or blood tests.

How many drinks can I have before I reach 0.08?
There are numerous factors that affect your Blood Alcohol Content (BAC). These include, but are not limited to, whether you are male or female, your age, and your height and weight.

Am I going to jail?
If this is your first criminal arrest, the answer is most likely no. However, all cases are different and we will have to review the facts of your case. The likelihood that you will have to serve jail time increases if you have previous DWI convictions.
